The terms governing your use of EuroFiducia's investment platform
Welcome to EuroFiducia ("we", "us", "our", the "Platform"). By accessing or using our website, mobile interface, and investment services, you ("you", the "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.
These Terms constitute a legally binding agreement between you and EuroFiducia SAS, a company registered in France, providing cross-border investment services to residents of France and Italy under applicable European regulations.
You must be at least 18 years of age and a legal resident of France or Italy (or an eligible European jurisdiction) to open an account. You must have the legal capacity to enter into binding contracts. By registering, you confirm that you are not legally prohibited from using investment services and that you are not acting on behalf of a person so prohibited.
To open an account, you must complete our four-step registration process: (1) Account details, (2) Identity/KYC verification, (3) Investor profile assessment, and (4) Compliance declarations. You agree to provide accurate, current, and complete information and to update such information to keep it accurate.
You are responsible for safeguarding your password and for all activity conducted under your account. You must notify us immediately of any unauthorized use of your account. You may reset your login credentials at any time through the password reset facility.
As a regulated investment platform, we are required by European AML directives (AMLD5/AMLD6) and national regulations (AMF in France, CONSOB in Italy) to verify your identity before activating your account. You must provide a valid government-issued identification document, proof of address, and such additional information as we may reasonably require.
We reserve the right to suspend or close accounts where verification cannot be completed or where information provided is found to be inaccurate, misleading, or fraudulent.
You may fund your account via SEPA bank transfer, debit/credit card, or open banking. All deposits are credited to your segregated client account and are available for investment once cleared. Withdrawals are processed to your verified bank account and may be subject to compliance review.
We aim to process withdrawals within 2โ5 business days depending on the method and compliance checks. Each deposit and withdrawal generates an official receipt with full transaction details, reference numbers, and processing codes.
Investments available on the Platform include stocks, ETFs, bonds (OAT, BTP), real estate (SCPI), sustainable/ESG funds, private equity, commodities, cryptoassets, retirement products (PER, pension), and cash/savings products (Livret A, LDDS).
Fees applicable to your account and investments are described in our Fees & Charges schedule. By using the Platform, you agree to pay all applicable fees. We may revise our fee schedule with reasonable notice. Management fees are deducted from portfolio performance and disclosed transparently in your dashboard.
We strive to maintain Platform availability 24 hours a day, but we do not guarantee uninterrupted access. The Platform may be unavailable due to maintenance, system updates, or circumstances beyond our control. We are not liable for losses arising from Platform unavailability.
All content on the Platform โ including text, graphics, logos, software, and design elements โ is the property of EuroFiducia or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
You agree not to: (a) use the Platform for any unlawful purpose; (b) attempt to gain unauthorized access to systems or data; (c) interfere with the proper functioning of the Platform; (d) provide false or misleading information; (e) engage in money laundering, fraud, or any activity prohibited under AML regulations; (f) use automated systems to access the Platform in a manner that sends more requests than a human reasonably could.
To the maximum extent permitted by law, EuroFiducia shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, arising from your use of the Platform. Our total liability for any claim shall not exceed the fees you have paid us in the twelve months preceding the claim.
This limitation does not apply to liability that cannot be excluded under applicable law, including liability for gross negligence, willful misconduct, or breach of regulatory obligations.
You may close your account at any time by contacting support, subject to the settlement of all open positions and withdrawal of remaining funds. We may suspend or terminate your account if you breach these Terms, if we are required to do so by law or regulatory authority, or if we suspect fraudulent or suspicious activity.
These Terms are governed by French law for French residents and Italian law for Italian residents, with EU regulations applying to cross-border matters. Disputes shall be resolved through negotiation, then mediation, and finally through the courts of your jurisdiction of residence. Consumers may also use the European Online Dispute Resolution platform.
We may update these Terms from time to time. We will notify you of material changes via email and dashboard message. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
